When you call to speak with an attorney at our either of offices, you will be asked a few basic questions prior to the appointment. This is to allow us to do what is known as a “conflict” check to make sure there are no potential conflicts in representation prior to the attorney meeting or speaking with you.
Prior to your meeting it is important to gather some initial documentation (to the extent possible) prior to your consultation to ensure that the attorney you are meeting with can review preliminary paperwork that you may have in your possession in order to address any questions or concerns you may have at the initial consultation.
Do your best to collect the following (if possible):
- income tax returns for at least the last three years (federal and state)
- business tax returns for at least the last three years (federal and state)
- proof of both spouses’ income (the last 3 months of paychecks, K-1, w-2 and 1099 forms)
- statements of any financial accounts, including checking and savings accounts, certificates of deposit, mutual funds and money market accounts
- real estate records (deeds, promissory notes, mortgage statements, appraisals of property, and the most recent tax bills)
- personal property, such as automobiles, furnishings, collectibles (make a list of your personal property, if possible)
- any prenuptial or post-nuptial agreements (if any have been entered into between you and your significant other)
- any court orders already in effect (including judgments or previous post-judgment modification orders)
- stocks, bonds, annuities, retirement plans, IRAs, pensions and profit sharing plans
- accrued vacation time (these may be found on paycheck stubs)
- whole life insurance policies
- trusts and estate planning documents in effect (including any powers of attorney)
- stock options (grant documents, vesting schedules and account statements)
- records of all debts (credit card statements, home equity lines of credit, student loans, unsecured loans, vehicle loans, and all other loans or evidence of debts)
If you are unable to gather all the documentation referenced on the checklist, do not worry as the attorney you will be meeting with will discuss what can be done to secure documentation that you may not have in your possession as the process progresses. The collection of the documentation is not required prior to your consultation with our firm, but rather an option so that any questions or concerns that you may have can be addressed at the initial meeting with the attorney.
